Jacque says he came up with the idea shortly after he was elected to office last session, after talking with a lawyer in the health care field.
According to the state Government Accountability Board, groups lobbying for the bill include several powerful insurance and business groups, builders, food processors, the tort reform group Wisconsin Civil Justice Council, as well as the Wisconsin Defense Council, which represents attorneys who represent injury defendants.
To describe the bill, personal injury attorney lawyer Clayton Griessmeyer on his blog uses the example of a biker who’s been hit by a drunken driver. Under Jacque’s proposal, “the drunk driver benefits, the insurance corporation having to pay the jury verdict benefits, the health insurance corporation gets its money back, and the biker gets nothing.”
